1. Introduction

Welcome to GymSync ("we," "our," or "us"). By accessing or using our mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

2. Beta Status Acknowledgement

You acknowledge that GymSync is currently in a Beta phase. This means:

  • The Service may contain bugs, errors, or inaccuracies.
  • The Service may experience interruptions or downtime.
  • Features may change, be added, or be removed without notice.
  • We are not liable for any data loss during this phase, although we take regular backups.

3. Accounts and Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or otherwise suspect any security breaches related to the Service.

4. User Conduct

You agree not to engage in any of the following prohibited activities:

  • Copying, distributing, or disclosing any part of the Service in any medium.
  • Using any automated system, including "robots," "spiders," or "offline readers," to access the Service.
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service.
  • Taking any action that imposes, or may impose at our sole discretion, an unreasonable or disproportionately large load on our infrastructure.
  • Harassing, abusing, or harming another person, particularly personal trainers or other athletes.

5. Health and Fitness Disclaimer

The Service provides a platform for managing fitness training but does not constitute medical advice. We are not responsible for any health problems that may result from training programs, consultations, products, or events you learn about through the Service. If you engage in any exercise program you receive through the Service, you agree that you do so at your own risk and are voluntarily participating in these activities.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall GymSync, its affiliates, agents, directors, employees, suppliers, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this Service.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will verify to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
